This Liability Waiver and Release Agreement ("Agreement") is entered into between Connexion Spa ("the Spa"), located at 36-18 Main Street, Flushing, New York, and the undersigned individual ("Guest"), in consideration of the Guest being permitted to use the Spa's facilities, services, and amenities.

1. Assumption of Risk & Personal Injury

The Guest acknowledges and understands that the use of spa facilities — including but not limited to saunas, steam rooms, hydrotherapy pools, massage tables, relaxation areas, and all other amenities — involves inherent risks of physical injury. These risks include, but are not limited to, slipping and falling on wet surfaces, muscle strain or soreness resulting from massage or bodywork treatments, adverse reactions to heat or steam, dizziness, dehydration, and other physical discomforts.

The Guest voluntarily assumes full responsibility for any and all risks of bodily injury, illness, or death arising from their participation in spa services and use of spa facilities, whether caused by the Spa's negligence or otherwise. The Guest confirms they are in good physical health and are not aware of any medical condition that would make the use of spa facilities inadvisable. The Guest agrees to immediately notify Spa staff of any discomfort, pain, or adverse reaction during their visit.

2. Release of Liability

In consideration of being permitted to use the Spa's facilities and receive its services, the Guest, on behalf of themselves and their heirs, personal representatives, and assigns, hereby releases, waives, discharges, and covenants not to sue Connexion Spa, its owners, officers, employees, agents, contractors, and affiliates (collectively, "Released Parties") from any and all claims, demands, losses, liabilities, damages, or causes of action — whether known or unknown, present or future — arising out of or related to the Guest's use of the Spa's facilities and services.

This release includes, but is not limited to, claims for personal injury, bodily injury, property damage, or wrongful death, regardless of whether such claims arise from the negligence of the Released Parties.

3. Loss of Personal Property & Valuables

The Spa strongly advises all Guests not to bring valuables — including jewelry, cash, electronics, or other personal items of significant value — onto the premises. The Spa provides lockers as a courtesy; however, the Guest acknowledges that the use of these lockers does not constitute a bailment and the Spa assumes no responsibility for the safekeeping of any personal property.

The Guest hereby releases the Released Parties from all liability for the loss, theft, or damage to any personal property, clothing, valuables, or other belongings brought onto the Spa's premises, regardless of the cause of such loss or damage.

4. Medical Conditions & Guest Responsibility

The Guest represents and warrants that they do not have any physical, medical, or mental condition that would impair their ability to safely use the Spa's facilities or receive its services, unless they have disclosed such conditions in writing to Spa management prior to their visit. The Guest accepts full personal responsibility for any adverse health effects that may arise as a result of undisclosed or pre-existing medical conditions.

The Guest agrees to follow all posted rules, safety guidelines, and staff instructions while on the Spa's premises. Failure to comply may result in the Guest being asked to leave without refund.

5. Indemnification

The Guest agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to the Guest's use of the Spa's facilities, the Guest's breach of this Agreement, or the Guest's violation of any applicable law or regulation.

6. Governing Law & Severability

This Agreement shall be governed by the laws of the State of New York. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

7. Acknowledgment

By signing below, the Guest confirms that they have read, understood, and voluntarily agree to all terms and conditions of this Waiver and Release Agreement, and that no representations, statements, or inducements other than those set forth herein have been made.
